FaxFree.net does not provide legal, medical, financial, or professional advice of any kind. The Service is not designed to guarantee compliance with industry-specific regulations (including but not limited to HIPAA, GLBA, SOX, or any similar laws).

If you are required by law or regulation to use special handling for certain types of data (such as protected health information), it is your responsibility to ensure that your use of FaxFree.net is appropriate and compliant. FaxFree.net makes no representation or warranty that the Service meets any such requirements.

4. Accounts and Paid Features

Certain features of the Service, such as express fax or other premium options, may require payment. Payment processing is handled by third-party providers. By submitting payment information, you authorize those providers to charge the applicable fees. All fees are non-refundable unless otherwise stated.

We may offer free, trial, or promotional features at our discretion. We reserve the right to modify or discontinue such features at any time.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation;
• Send spam, unsolicited mass faxes, or bulk messages;
• Harass, threaten, or defraud any person or entity;
• Transmit content that is defamatory, obscene, infringing, or otherwise unlawful;

6. Fax Delivery, Reliability, and Disclaimers

While we strive to provide a reliable fax-sending experience, fax transmission depends on many factors beyond our control, including telephone carriers, recipient fax machines, network conditions, and third-party infrastructure.

We do not guarantee:

• That any fax will be delivered successfully;
• That delivery receipts or status indicators will always be accurate or available;
• Any minimum delivery speed or service level agreement (SLA).

You are responsible for verifying that important faxes have been received by the intended recipient through independent means, such as direct confirmation.

7. Content Ownership

You retain ownership of any documents or content you upload to the Service. By using the Service, you grant FaxFree.net a limited, non-exclusive license to store, process, and transmit your documents as necessary to operate the Service and fulfill your requests.

If you wish to request deletion of fax documents stored by the Service, you may do so at any time by submitting a Deletion Request Form. Requests will be processed within 7 business days, and you will receive a confirmation email upon completion. Please note that certain non-document information such as transmission logs and metadata may be retained for operational, security, or legal purposes even after a document deletion request is fulfilled.

We may also use aggregated and de-identified information derived from your use of the Service for analytics, improvement, and business purposes, in accordance with our Privacy Policy.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share information, including your rights regarding document deletion requests. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service solely for its intended purpose. 11. Disclaimer of Warranties

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR ANY RELATED SYSTEMS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FAXFREE.NET, ITS OWNERS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY LIABILITY IS FOUND DESPITE THE ABOVE, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 30 DAYS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN U.S. DOLLARS (US $10).

You agree to defend, indemnify, and hold harmless FaxFree.net, its owners, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the Service;
• Your violation of these Terms;
• Your violation of any law or third-party rights;
• Any content or documents you transmit using the Service.

14. Changes to the Service and Terms

We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We may also update these Terms from time to time. When we do, we will update the “Last updated” date above.

Your continued use of the Service after changes to the Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
